On October 24, 2017, City Council will provide direction to staff regarding development regulations for Accessory Dwelling Units (ADUs) and consider initiating amendments to Santa Barbara Municipal Code Titles 28 and 30 (Zoning Ordinance), establishing regulations for ADUs.  Effective January 1, 2017, state legislation (AB 2299 and SB 1069) supersedes the City's former regulations for “secondary dwelling units” (applicable in the single unit residential zones) and “accessory dwelling units” (applicable in the two unit residential zones) until the City adopts its own ordinance.  In the meantime, staff is required to ministerially approve ADUs if the unit complies with the provisions of state law.  In April 2017, City Council directed staff to prioritize work on developing a local ordinance to regulate ADUs. 

Following Council direction on October 24, 2017, a revised Draft ADU Ordinance will be presented to the Planning Commission and Ordinance Committee for review and refinement, before returning to the City Council for introduction and adoption.  Absent any other specific direction from City Council, the development regulations of the City’s ADU Ordinance would apply to building permits issued after the effective date of the ADU Ordinance, anticipated to occur around January 2018. 

On a parallel path, the City’s Water Commission held a discussion on September 21, 2017 regarding water metering requirements for Accessory Dwelling Units. The Water Commission supported staff’s recommendation that the Ordinance Committee, and subsequently Council, adopt proposed changes to Title 14 of the Santa Barbara Municipal Code.  On October 24, 2017, staff is requesting direction from Council to introduce the Title 14 ordinance amendment at a subsequent Council meeting.

On Thursday, October 19, 2017, an Agenda with all items to be heard on Tuesday, October 24, 2017 will be available at 735 Anacapa Street and at the Central Library.  The agenda and staff report will also be available at Regular meetings of the Council are broadcast live and rebroadcast on Wednesdays and Thursdays at 7:00 p.m. and on Saturday at 9:00 a.m. on City TV Channel 18.  These meetings can also be viewed over the Internet at  Point to GOVERNMENT, point to City Hall and click on Mayor & City Council; click on City Council Meetings, City Council Meetings Online, and then click on the Video link associated with the meeting date.
