NEW ZONING ORDINANCE (TITLE 30) APPLICABILTY

New Zoning Ordinance (Title 30) Applicability

The City Council has adopted a New Zoning Ordinance (NZO), Title 30 of the Municipal Code. While the majority of the changes in the NZO are intended to modernize, streamline, and provide more flexibility, some of the proposed changes may affect projects currently in progress.

The New Zoning Ordinance (NZO), will go into effect on October 1, 2017.  Projects that meet the following criteria prior to the effective date may continue using the City’s existing Zoning Ordinance (Title 28) or choose to revise their project to meet the New Zoning Ordinance (Title 30).  Projects that do not meet one of the following criteria prior to October 1, 2017 will have to comply with the New Zoning Ordinance (Title 30):

  • Discretionary applications “deemed complete”;
  • Unexpired projects that received Final Approval or Project Design Approval from the Architectural Board of Review, Historic Landmarks Commission or Single Family Design Board;
  • Unexpired projects that received a discretionary land use approval, such as, conditional use permit, modification, subdivision, etc.); or
  • Unexpired ministerial projects that have a building permit issued.

Please note, at the time of resubmittal you will be required to identify under which Title of the Municipal Code the project will be proposed.

The existing Zoning Ordinance (Title 28) regulations will continue to apply to property located in the Coastal Zone until the NZO is certified by the California Coastal Commission, tentatively anticipated for late 2018/early 2019.
