The City Council adopted the Tenant Displacement Assistance Ordinance (TDAO) on November 21, 2006.  This ordinance becomes effective on December 21, 2006 and will apply to all ministerial and discretionary projects within the City of Santa Barbara.   This includes applications to design review boards, Planning Commission, Staff Hearing Officer, building permits and demolition permits.

The new ordinance provides a mechanism for assisting tenants that will be displaced when their rental units are eliminated.   The City currently has an ordinance that provides tenant assistance when existing units are converted to condominiums (Condominium Conversion Ordinance).  However, prior to the introduction of the TDAO, there was no tenant assistance for tenants of units that are eliminated by demolition, redevelopment, merger of units or change of use to a non-residential use (commercial use).

Any land use permit resulting in the elimination of a unit(s) would trigger the application of the TDAO to existing tenants or to tenants that may have occupied the units six months prior to the filing of the  application (unless their term lease had expired). 

The TDAO is not intended to apply to circumstances where a landlord seeks to recover possession of the rental to upgrade the units nor will it apply when the tenants are evicted for violation of their rental agreement.

Key provisions of the ordinance include:

·         Tenant notice 60 days before an application is filed

·         Right to terminate lease

·         Monetary assistance or functional equivalent to assist with relocation

·         First Right of  Refusal (Right to Purchase) if new units are proposed

·         Displacement or Counseling Plan

Notice of Intent to File an Application

(Letter from Community Development Director regarding required Notice of Intent to File an Application.)

The ordinance requires that all property owners notify all tenants on the property via a Notice of Intent to File an Application that an application will be filed with the City.  The notice explains to tenants how the ordinance will apply.  To assist owners with notification, the attached Notice of Intent to File an Application has been developed.
